DMCA Policy

Noem Témoigne respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond promptly to notices of alleged copyright infringement that are properly provided to us.

This page outlines the procedure for filing copyright infringement notifications and counter-notifications with Noem Témoigne.

Filing a Copyright Infringement Notice (DMCA Takedown Notice)

If you believe that material available on Noem Témoigne infringes on your copyright, please send a written notification to our designated copyright agent containing the following information (as required by Section 512(c)(3) of the DMCA):

  1. Identification of the copyrighted work claimed to have been infringed: Provide a detailed description of the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the material that is claimed to be infringing: Provide specific URL(s) on Noem Témoigne where the allegedly infringing material is located. Please provide enough information to allow us to locate the material.
  3. Information reasonably sufficient to permit Noem Témoigne to contact you: This includes your full name, mailing address, telephone number, and email address.
  4. A statement that you have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (e.g., as a "fair use"): This must be a clear and unequivocal statement.
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed: This legally binding statement is crucial.
  6. Your physical or electronic signature: This can be a scanned signature or a valid electronic signature.

Upon receipt of a valid DMCA takedown notice, Noem Témoigne will promptly remove or disable access to the infringing material and will take reasonable steps to notify the user who posted the material.

Filing a Counter-Notification

If you believe that your content was removed or disabled as a result of mistake or misidentification, you have the right to submit a counter-notification pursuant to sections 512(g)(2) and (3) of the DMCA. Your counter-notification must include substantially the following:

  • Identification of the material that has been removed or to which access has been disabled: Provide the specific URL(s) on Noem Témoigne where the material appeared before it was removed or disabled.
  • Your full name, mailing address, telephone number, and email address: This information will be forwarded to the copyright complainant.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located: If your address is outside of the United States, you must state that you consent to jurisdiction of any judicial district in which Noem Témoigne may be found.
  • A statement that you will accept service of process from the person who provided the original DMCA notification or an agent of such person: This confirms your willingness to engage in legal proceedings if necessary.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your physical or electronic signature.

Upon receipt of a valid counter-notification, Noem Témoigne will promptly provide the copyright complainant with a copy of your counter-notification and inform them that we will replace the removed material or cease disabling access to it within 10 business days unless we receive notice from the complainant that they have filed an action seeking a court order to restrain you from engaging in infringing activity.
